For the purpose of these Terms & Conditions:
"MLB Photographic", "MLB", "Photographer", "We", "Us" or "Our" refers to MLB Photographic, owned and operated by Lyndsey Wherry.
"Client", "You" or "Your" refers to the individual(s) booking a photography session, purchasing products or digital images, or entering into any agreement with MLB Photographic.
"Session" refers to any photography service provided by MLB Photographic, including but not limited to Newborn, Maternity, Family, Sitter, Cake Smash, Pet Portraits, Mini Sessions, Christmas Sessions and Model Calls.
"Products" refers to all printed photographs, albums, USB presentation boxes, wall art, framed products, digital downloads and any other photographic products supplied by MLB Photographic.
These Terms & Conditions apply to every booking made with MLB Photographic.
By paying a booking fee, purchasing products or entering into a payment plan, you confirm that you have read, understood and agree to these Terms & Conditions.
2.1 These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
2.2 Any disputes arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
2.3 These Terms & Conditions may only be amended in writing by MLB Photographic.
2.4 Should any clause within these Terms & Conditions become unenforceable or invalid, all remaining clauses shall remain in full force and effect.
Your booking is not confirmed until:
• A completed booking form (where applicable) has been received.
• The required booking fee has been paid.
• Confirmation has been issued by MLB Photographic.
Dates cannot be reserved without payment.
Booking fees secure your chosen session date and cover administration, diary reservation and preparation.
Booking fees are:
• Non-refundable.
• Non-transferable except where agreed by MLB Photographic.
• Deducted from your chosen collection or package where applicable.
Bookings are accepted on a first-come, first-served basis.
Until the booking fee has been received, MLB Photographic reserves the right to offer the session date to another client.
Any promotional pricing, discounts, model calls or special offers are available only during the advertised promotional period.
Offers cannot be combined unless specifically stated.
Unless otherwise agreed in writing:
• All balances must be paid by the due date advised by MLB Photographic.
• Certain sessions require payment before the session takes place.
• Orders for products and additional digital images must be paid in full before production begins.
No products or images will be released until your account has been paid in full.
This includes:
• Online Galleries
• Digital Downloads
• USB Presentation Boxes
• Prints
• Albums
• Wall Art
• Gift Products
• Any other purchased items
MLB Photographic reserves the right to withhold editing, ordering and delivery until payment has cleared.
Payments may be made via:
• Bank Transfer
• Cash (by prior arrangement)
Other payment methods may be accepted at the discretion of MLB Photographic.
MLB Photographic understands that professional photography is an investment and, where appropriate, may offer payment plans.
Payment plans are offered entirely at the discretion of MLB Photographic.
Approval of one payment plan does not guarantee future payment plans.
By entering into a payment plan you agree to:
• Make every payment on or before the agreed due date.
• Ensure sufficient funds are available.
• Contact MLB Photographic before the due date if you believe payment may be delayed.
• Continue communicating until the balance has been cleared.
Failure to make an agreed instalment may result in:
• The payment plan being withdrawn.
• The remaining balance becoming immediately payable.
• Editing work being suspended.
• Orders being placed on hold.
• Future bookings being refused.
If multiple instalments are missed or communication ceases, MLB Photographic reserves the right to cancel the payment plan entirely.
Any remaining balance will become immediately due.
MLB Photographic appreciates that unexpected financial difficulties can arise.
If you believe you may struggle to make a payment, please contact us before the due date.
In many cases an alternative arrangement can be agreed.
Communication is always appreciated.
Ignoring payment reminders is not.
Where payment becomes overdue:
MLB Photographic may:
• Suspend editing work.
• Delay product orders.
• Withhold galleries.
• Withhold digital images.
• Withhold prints, albums and USBs.
• Refuse future bookings.
• Withdraw any agreed payment plan.
Failure to respond to repeated payment reminders may be considered a breach of these Terms & Conditions.
Repeated failure to communicate may result in:
• Immediate payment of the outstanding balance being requested.
• Recovery action being commenced.
• Future services being refused.
Should payment remain outstanding after reasonable reminder notices have been issued, MLB Photographic reserves the right to:
• Refer the account to a debt recovery agency.
• Commence legal proceedings through the County Court (Small Claims Track).
• Recover any court fees, debt recovery costs or other reasonable costs where legally recoverable.
MLB Photographic reserves the right to charge reasonable administrative costs associated with recovering overdue accounts where permitted by law.
Clients with overdue balances will not be permitted to book additional sessions until their account has been cleared in full.
Repeat late payment may result in future bookings being refused.
Clients agree to:
• Pay all invoices by the agreed dates.
• Keep MLB Photographic updated if circumstances change.
• Check payment details before making transfers.
• Ensure payments are made using the correct reference where requested.
MLB Photographic always aims to treat clients fairly and with understanding.
Where genuine financial hardship arises, every effort will be made to agree an alternative arrangement provided communication takes place before payments become overdue.
Failure to communicate may result in the withdrawal of this goodwill and the enforcement of these Terms & Conditions.
Session durations are approximate and may vary depending on the type of session booked.
Typical session lengths are:
• Newborn Sessions – Allow up to 4 hours (baby-led)
• Maternity Sessions – 1–2 hours
• Family Sessions – Approximately 1 hour
• Cake Smash & Splash Sessions – Approximately 1–2 hours
• Sitter Sessions – Approximately 45–60 minutes
• Mini Sessions – As advertised
MLB Photographic will never rush a session where doing so may compromise safety or the quality of your photographs.
Clients are requested to arrive on time.
Late arrival may reduce your session time.
If you arrive more than 20 minutes late without prior communication, MLB Photographic reserves the right to shorten or cancel the session if it would impact other bookings.
The full session fee remains payable.
MLB Photographic operates from a private home studio.
Clients are asked to respect the property and follow any instructions given during their visit.
Only those attending the session should enter the studio unless agreed in advance.
Children remain the responsibility of their parent or guardian at all times unless they are being safely photographed by MLB Photographic.
Clients agree to:
• Arrive on time.
• Inform MLB Photographic of any medical conditions or special requirements that may affect the session.
• Dress appropriately for the session.
• Bring any requested items, clothing or sentimental props discussed before the session.
• Supervise children when they are not being photographed.
MLB Photographic accepts no responsibility for personal belongings brought to the session.
If you need to change your session date, please provide as much notice as possible.
Where sufficient notice is given, MLB Photographic will make every reasonable effort to offer an alternative date.
However, new dates cannot be guaranteed and are subject to availability.
Requests made with less than 72 hours' notice may result in the booking fee being forfeited unless the reason falls within the illness policy below or another exceptional circumstance accepted by MLB Photographic.
One complimentary rearrangement may be offered at the discretion of MLB Photographic.
Further requests to move the booking may require a new booking fee.
Booking fees are non-refundable.
This includes situations where the client decides they no longer wish to proceed with the booking.
Where a client cancels after paying additional monies beyond the booking fee:
• Products already ordered cannot be refunded.
• Editing work already completed cannot be refunded.
• Refunds relating to unused session balances remain entirely at the discretion of MLB Photographic.
Failure to attend a booked session without prior notice will result in:
• Loss of the booking fee.
• Any remaining balance becoming payable where contractually agreed.
• A new booking fee being required before another session can be arranged.
The safety of newborns, babies, children and vulnerable family members is extremely important.
For this reason, MLB Photographic reserves the right to postpone any session where illness may present a risk.
Please contact MLB Photographic as soon as possible if anyone attending your session has:
• A sickness bug
• Flu or flu-like symptoms
• COVID-19 (or similar contagious illness)
• Chickenpox
• Hand, Foot & Mouth
• Conjunctivitis
• Heavy cold symptoms
• Any contagious illness
Where appropriate, your session will simply be rearranged.
There will be no penalty for postponing due to genuine illness.
If MLB Photographic becomes ill or is unable to photograph your session due to illness or emergency:
• Your session will be rearranged at the earliest mutually convenient opportunity.
• Booking fees and payments will be transferred to the new date.
• No additional charge will apply.
Because newborn sessions are time-sensitive, every effort will be made to rearrange your session as quickly as possible.
MLB Photographic cannot guarantee identical posing opportunities if your baby is older by the rearranged session date.
Outdoor sessions are weather dependent.
Where weather conditions are unsuitable or unsafe, MLB Photographic will rearrange the session at no additional charge.
The Photographer's decision regarding weather suitability is final.
Newborn safety will always take priority over any photograph.
Certain poses may require composite editing.
These images are created safely using multiple photographs and should never be attempted at home.
MLB Photographic reserves the right to omit any pose that is considered unsafe or unsuitable for your baby.
Children must remain supervised by their parent or guardian whenever they are not actively being photographed.
MLB Photographic cannot be held responsible for accidents caused by children running around the studio or failing to follow instructions.
Parents remain responsible for their children's behaviour throughout the session.
Pets are welcome where previously agreed.
Owners remain responsible for:
• Their pet's behaviour.
• Cleaning up after their pet.
• Ensuring their pet is safe to be around children.
MLB Photographic reserves the right to stop the session if a pet becomes aggressive or presents a safety risk.
MLB Photographic shall not be liable for failure to fulfil its obligations where prevented from doing so by circumstances beyond reasonable control.
These include (but are not limited to):
• Serious illness
• Family bereavement
• Accident
• Fire
• Flood
• Extreme weather
• Power failure
• Internet failure
• Equipment failure
• Government restrictions
• National emergencies
• Acts of God
In such circumstances every reasonable effort will be made to rearrange your session.
Where products have already been ordered or work has already commenced, refunds may not be available.
Photography is an artistic service.
While every effort is made to capture a wide variety of beautiful images, MLB Photographic cannot guarantee:
• Exact poses.
• Exact facial expressions.
• Particular smiles.
• Sleeping newborns.
• The cooperation of babies or young children.
• Specific numbers of images.
Every child is different and every session is unique.
The Photographer will always work patiently and professionally to achieve the best possible results while ensuring everyone remains safe, comfortable and relaxed.
MLB Photographic reserves the right to end a session without refund if:
• A client behaves in an abusive or threatening manner.
• Anyone attending is under the influence of alcohol or drugs.
• Instructions relating to health or safety are repeatedly ignored.
• The safety of any person or animal is compromised.
When booking MLB Photographic, clients acknowledge that they are familiar with and accept the Photographer's editing style and portfolio.
Images will be edited in MLB Photographic's signature style, including colour grading, retouching, textures and artistic enhancements where appropriate.
Editing style is entirely at the Photographer's artistic discretion.
Every purchased image receives professional retouching, which may include:
• Skin smoothing where appropriate
• Temporary blemish removal
• Colour correction
• Exposure adjustments
• Cropping and composition
• Artistic finishing
• Conversion to black & white where included within your package
Extensive editing requests beyond MLB Photographic's standard workflow are not included.
Examples include:
• Body reshaping
• Head swaps
• Digital weight loss
• Extensive object removal
• Major background alterations
• Composite requests beyond those already included
Additional editing is entirely at the Photographer's discretion and may incur an additional charge.
Current additional editing fee:
£55 per image
Any editing requests must be made during your gallery viewing period.
Once products have been ordered or digital files supplied, further alterations cannot normally be made.
Following your session, MLB Photographic will carefully select and edit the best images.
Only photographs meeting MLB Photographic's quality standards will be included.
Unedited RAW files will never be supplied.
Your password-protected online gallery will remain active for 48 hours from the time your password is issued unless otherwise advised.
Clients are encouraged to make their selections promptly.
Once your gallery has expired it will be removed from the online system.
If you require access after expiry, a Gallery Reactivation Fee will apply.
Current Gallery Reactivation Fee:
£150
Reactivation is subject to image availability.
MLB Photographic is not responsible for storing client images indefinitely.
Images are archived for a limited period at the Photographer's discretion.
Clients are strongly advised to download and safely back up all purchased digital images immediately after delivery.
Unless otherwise stated:
The Photographer selects the images presented within your gallery.
Duplicate photographs, test images, blinks, out-of-focus photographs and similar images will not be included.
The Photographer's decision regarding image selection is final.
Clients may purchase additional digital images, prints or products from their online gallery where available.
Prices are subject to change without notice.
However, prices quoted at the time your gallery is delivered will remain valid throughout your gallery viewing period.
All products and additional images must be paid for in full before production begins.
No orders will be placed until cleared funds have been received.
Once an order has been submitted to the professional print laboratory or supplier, changes cannot be made.
Please check all selections carefully before confirming your order.
MLB Photographic uses carefully selected professional photographic laboratories.
Professional products are designed to provide significantly higher quality and longevity than consumer printing services.
Images are edited using professionally calibrated monitors.
MLB Photographic cannot accept responsibility for colour differences caused by:
• Mobile phones
• Tablets
• Uncalibrated computer monitors
• Consumer printers
• Third-party laboratories
Colours may therefore differ slightly between devices.
Clients choosing to print their digital images elsewhere do so entirely at their own risk.
MLB Photographic accepts no responsibility for poor quality prints produced by third-party companies.
Estimated delivery times are provided as guidance only.
Products may occasionally take longer due to circumstances outside MLB Photographic's control, including:
• Supplier delays
• Manufacturer delays
• Seasonal demand (including Christmas)
• Courier delays
• Material shortages
• Postal disruption
MLB Photographic will always keep clients informed where delays occur.
Where delays are caused by third-party suppliers, MLB Photographic cannot be held liable for timescales outside its control.
Clients will be contacted once products are ready for collection.
Products should be collected within a reasonable period unless alternative arrangements have been agreed.
Where products are posted:
Risk passes to the client once the parcel has been handed to the delivery company.
MLB Photographic will assist wherever possible with courier claims but cannot guarantee replacement where loss or damage occurs during transit.
Digital images supplied by MLB Photographic are high-resolution files suitable for personal printing.
Clients are responsible for downloading and backing up their purchased files.
MLB Photographic cannot guarantee replacement copies once archive periods have expired.
Clients should only print using reputable photographic laboratories to achieve the best results.
Clients are strongly advised to:
• Save copies to multiple devices.
• Back up files to cloud storage.
• Keep original downloaded files.
Replacement files may not always be available.
Presentation boxes and USB products are handmade by professional suppliers.
Natural variations in wood grain, leather, fabric and handcrafted finishes are normal and do not constitute faults.
Should a product arrive damaged or faulty:
MLB Photographic must be notified within 14 days of collection or delivery.
Where a manufacturing fault is confirmed, the product will be repaired or replaced at no additional charge.
Due to the personalised nature of photographic products:
Products cannot be returned simply because:
• You changed your mind.
• An incorrect size was chosen.
• An incorrect image was selected by the client.
Returns will only be accepted where:
• The product is faulty.
• The wrong product has been supplied.
• There has been a manufacturing defect.
Every effort is made to produce exceptional photographs.
However, photography remains an artistic service.
No guarantee is given regarding:
• The number of final images.
• Exact poses.
• Facial expressions.
• Sleeping newborns.
• The cooperation of babies, children or pets.
The Photographer will always deliver the strongest possible collection from each individual session.
In accordance with the Copyright, Designs and Patents Act 1988, all copyright and intellectual property rights in every photograph remain the sole property of MLB Photographic unless otherwise agreed in writing.
Purchasing digital images or printed products does not transfer copyright ownership.
Purchased digital images are supplied with a personal-use licence.
This licence allows the client to:
• Print the images for personal use.
• Display the images within their home.
• Share the images on personal social media accounts.
The licence does not permit commercial use.
Images may not be used for:
• Business advertising
• Competitions
• Publications
• Marketing
• Sale
• Commercial websites
without prior written permission from MLB Photographic.
Commercial licences are available upon request.
To protect the quality and integrity of MLB Photographic's work, clients must not:
• Apply filters.
• Change colours.
• Crop significantly.
• Add text or graphics.
• Remove watermarks.
• Edit or manipulate the photographs in any way.
If alternative crops or versions are required, please contact MLB Photographic.
Clients must not:
• Screenshot online gallery images.
• Copy preview images.
• Download watermarked proofs.
• Save images from social media.
• Scan printed photographs.
• Photograph prints or albums for reproduction.
Only purchased digital images may be downloaded and printed.
Clients are warmly encouraged to share their purchased images online.
When doing so, MLB Photographic kindly asks that:
• MLB Photographic is credited where possible.
• Images remain unedited.
• No filters are applied.
This helps preserve the Photographer's artistic style and professional reputation.
Unless the client has specifically requested otherwise in writing before the session, MLB Photographic reserves the right to use photographs for:
• Portfolio display
• Studio samples
• Website
• Social media
• Advertising
• Printed marketing
• Competition entries
• Professional awards
• Educational purposes
No sensitive images will ever be used without separate written consent.
Images displaying newborn genitalia will never be published.
The dignity and privacy of every client will always be respected.
Model Calls are offered at heavily reduced prices in exchange for permission to use the resulting images for marketing purposes.
By booking a Model Call you agree that:
• Images may be used on social media.
• Images may appear on the website.
• Images may appear in printed marketing.
• Images may be used within the studio.
• Images may be used for future advertising.
Participation in a Model Call cannot remain private.
Model Calls exist to allow MLB Photographic to develop new ideas, props, styling and techniques.
Clients understand that:
• Outfit choices may be determined by the Photographer.
• Certain poses may be requested.
• Styling decisions remain at the Photographer's discretion.
• Images supplied may differ from standard sessions.
Submitting an application does not guarantee selection.
The Photographer's decision is final.
Model Call booking fees are non-refundable.
Failure to attend without notice will result in forfeiture of the booking fee.
By attending a session the client confirms:
• They have permission to photograph everyone attending.
• They are the parent or legal guardian of any children attending.
• They have authority to agree to these Terms & Conditions.
MLB Photographic takes your privacy seriously.
Personal information is collected solely for the purpose of:
• Booking sessions.
• Processing payments.
• Delivering products.
• Maintaining business records.
• Contacting clients regarding bookings.
Information will never be sold or shared with third parties except where necessary to fulfil your order (for example, professional print laboratories or delivery companies).
Client information is stored securely.
Reasonable steps are taken to protect personal information from unauthorised access.
MLB Photographic archives photographs for a limited period only.
Clients remain responsible for backing up purchased digital images.
MLB Photographic maintains appropriate public liability insurance.
Every reasonable care is taken throughout every session.
However, MLB Photographic shall not be liable for:
• Injury caused through failure to follow instructions.
• Damage to personal belongings.
• Accidents caused by unsupervised children.
• Loss arising from circumstances beyond reasonable control.
The Photographer reserves the right to stop any session immediately where safety may be compromised.
This includes situations involving:
• Unsafe behaviour.
• Aggressive pets.
• Dangerous props supplied by clients.
• Failure to follow instructions.
• Intoxication.
• Abuse towards the Photographer.
The Photographer's decision regarding safety is final.
If you are unhappy with any aspect of your experience, please contact MLB Photographic as soon as possible.
Every effort will be made to resolve concerns fairly and professionally.
Complaints regarding products must be made within 14 days of collection or delivery.
Whilst every reasonable effort is made to provide exceptional service, MLB Photographic's total liability shall not exceed the total amount paid by the client.
No liability is accepted for indirect or consequential losses.
MLB Photographic shall not be liable for failure to perform obligations due to circumstances beyond reasonable control including, but not limited to:
• Natural disasters
• Severe weather
• Fire
• Flood
• Illness
• Equipment failure
• Government restrictions
• Power failure
• Internet outages
• Acts of God
Every reasonable effort will be made to rearrange sessions where possible.
These Terms & Conditions constitute the entire agreement between MLB Photographic and the Client.
No verbal statement shall override these Terms unless confirmed in writing.
Payment of a booking fee, session fee, product order or entry into a payment plan confirms that the Client has read, understood and accepted these Terms & Conditions in full.

Photography is an artistic service. By booking MLB Photographic, the Client acknowledges they are familiar with the Photographer's portfolio and editing style. Refunds will not be given because a Client changes their mind about artistic style, posing, colour tones, composition or editing where the work is consistent with MLB Photographic's published portfolio.
